1. Introduction

These Terms and Conditions ("Terms") govern your use of the Kaya Thai Therapy Ltd website (https://kayathaitherapy.co.uk) and the booking of any therapeutic treatments or services provided by us. By accessing our website or booking an appointment, you agree to be bound by these Terms.

Kaya Thai Therapy Ltd is a company registered in England and Wales.

2. Booking and Appointments

  • Advance Booking: Appointments are subject to availability. We recommend booking in advance to secure your preferred time.
  • Deposit: We reserve the right to request a non-refundable deposit at the time of booking to secure your appointment.
  • Late Arrival: Please arrive at least 5 minutes prior to your scheduled appointment time. If you arrive late, your treatment time may be shortened to ensure the next client is not delayed. The full price of the treatment will still apply.

3. Cancellation and Rescheduling Policy

To operate a sustainable business, strict cancellation policies apply:

  • 24-Hour Notice: You may reschedule or cancel your appointment free of charge up to 24 hours before the scheduled start time.
  • Late Cancellation: Cancellations made within 24 hours of the appointment will incur a charge equal to 50% of the treatment cost.
  • No-Show: Failure to attend an appointment without prior notice will result in a charge equal to 100% of the treatment cost.
  • Our Rights: In the unlikely event that we need to cancel your appointment due to staff illness or emergency, we will offer you a full refund or priority rescheduling.

4. Health and Medical Disclaimer

Kaya Thai Therapy Ltd provides therapeutic massage for relaxation and musculoskeletal support. We are not a medical practice.

  • Client Disclosure: You are required to disclose all relevant medical conditions, injuries, allergies, or pregnancy status prior to treatment. A consultation form must be completed before your first session.
  • Contraindications: We reserve the right to refuse treatment if we believe it may be unsafe for you due to a medical condition (e.g., infectious skin conditions, fever, unstable blood pressure).
  • Not Medical Advice: Our therapists do not diagnose medical conditions. Our treatments are not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician for any medical concerns.

5. Client Conduct

We maintain a professional and safe environment for both clients and therapists.

  • Zero Tolerance: Any sexual harassment, inappropriate behaviour, or aggression towards our staff will result in the immediate termination of the treatment. You will be liable for the full cost of the session, and the incident may be reported to the relevant authorities.
  • Hygiene: We request that clients maintain a reasonable level of personal hygiene prior to attending their appointment.

6. Pricing and Payment

  • Currency: All prices are quoted in Great British Pounds (GBP).
  • Payment Methods: We accept payment via major credit/debit cards and contactless payment. Cash is accepted at the studio.
  • Price Changes: We reserve the right to alter our pricing at any time. The price applicable to your booking is the price valid at the time of confirmation.

7. Limitation of Liability

Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or for fraud.

  • Valuables: We are not responsible for the loss or damage of any personal belongings or valuables brought into the studio.
  • Indirect Loss: To the extent permitted by law, Kaya Thai Therapy Ltd shall not be liable for any indirect or consequential loss arising from your use of our services.

8. Privacy and Data Protection

We process your personal data, including Special Category Health Data, in accordance with our Privacy Policy. By booking a treatment, you acknowledge that you have read and understood how we process your health data under Article 9(2)(h) of the UK GDPR.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
